What is the Defender Trophy?

Defender Trophy is a global adventure challenge programme with a purposeful mission at its core. Epic Adventure with Greater Purpose.
The programme consists of a series of competitive selection events in select countries around the world from 2025 to 2026, refer to the list of participating countries, culminating in an epic global final in October 2026.
The objective is to build a global community of inspired Defender advocates who love a challenge and who support conservation causes.
What is the Competition and what is the Reward?

The competition comprises a series of team-based challenges. Participants will navigate some of the world’s most brutal and unforgiving terrain, along the way facing engineering, and physical challenges that may seem impossible to overcome. It will test wit, willpower and teamwork. Every decision will count.
To win the Defender Trophy, competitors will need to prove the superior collective value of their character, personality, skills, sociability, inventiveness and collaboration.
The reward for the winners is to take part in the final mission. This will be an exhilarating expedition where they will use everything they have learned and unleash their skills to make a real impact on conservation efforts and purposeful causes.
Is it a race?

No, this is a competition but not a race, there may be timed elements within the competition, but these will have strict controls. Competitors must ensure they always drive responsibly.
Who can take part?

Individuals with an adventurous mindset – people who prefer to ‘do more’ than ‘have more’.
They are not age or gender defined, but are courageous and ambitious, liberated pioneers who have a desire to give back. To make a difference. These are not professional athletes; they are from all walks of life and have an insatiable thirst for adventure. They are fit, positive, collaborative and competitive. Defender Trophy is personal to them – they thrive in being part of its success.
In summary, we are looking for people who reflect true Defender values and are excited by a challenge.
Residents in participating countries can apply as long as they meet the eligibility criteria and accept the Terms and conditions, see here [LINK].
What are the eligibility criteria?

Full eligibility criteria are described in the application form and terms and conditions [HERE].
Some of the eligibility requirements include: that entrants must be 23 years or over, fit to complete a demanding adventure challenge, must have a driving licence, be able to travel internationally, can swim 50m unassisted and unaided, communicate fluently in English, and acknowledge and accept that they will be living outdoor for several weeks and that they will be filmed and photographed.
We will not be accepting applications from employees of JLR or competitor automotive brands.
Do I need to be an athlete to apply?

No. Anyone who meets the eligibility criteria and has read and accepted the terms and conditions can apply. Participants will need to have a reasonable level of resilience to endure what will be an arduous challenge.
I am disabled/differently abled; can I apply?

Will this be televised?

The Defender Trophy team are aiming to broadcast the competition across Defender owned channels/platforms including YouTube and social media channels.
When will the competition take place?

The opening and closing dates for applications will vary by country.
National selection events will follow the application closing date and will be different for each participating country. All global winners will be announced in August 2026. The global final is anticipated to take place in October 2026. Confirmed dates will be announced during the competition process.
Where will the global final take place?

The first Defender Trophy global final is currently under development with the aim to take place in southern Africa in authentic and challenging surroundings where Defender is already contributing to local causes reflecting JLR’S 20-year association with TUSK org.
Precise locations will be announced later in the competition process.

For more than 70 years Defender models have explored the world’s extremes. This unique legacy inspires a new breed of challenge for a new generation of adventurers and pioneers.
Which countries are taking part?

In the first season of the programme, we are welcoming applicants and selecting winners from the residents of the USA, Canada, China, Japan, Taiwan, South Africa, Germany, Italy, Spain, France, Belgium, the Netherlands, Austria, Switzerland and other European countries as well as countries in the Asia Pacific and the Gulf Region. TERMS AND CONDITIONS
These terms and conditions (“Terms and Conditions”) apply to the Defender Trophy Challenge (the "Competition”) which will take place between 19 June 2025 and 31 October 2026 (“Competition Period”).
TERMS AND CONDITIONS
1. By entering the Competition you confirm your acceptance and agree to these Terms and Conditions.
2. The Competition is promoted and managed by JAGUAR LAND ROVER SOUTH AFRICA (PTY) LIMITED (the “Promoter”) a company incorporated and registered under the laws of South Africa with company registration number 2001/027269/07 and whose registered office is at 28 Victoria Link, Route 21 Corporate Park, Nellmapius Drive, Irene X30, 0157 . The global portion of the Competition, including the Global Final, is arranged and supported by Jaguar Land Rover Limited, a company incorporated and registered in England and Wales with company number 1672070, and whose registered office is at Abbey Road, Whitley, Coventry, CV3 4LF, United Kingdom
3. These Terms and Conditions apply so far as the law permits so, please read them carefully before entering.
4. These Terms and Conditions shall be governed by and construed in accordance with the laws of South Africa. The parties irrevocably agree that the courts of South Africa shall have exclusive jurisdiction to deal with any dispute or claim that arises out of or in connection with these Terms and Conditions and the Competition.
CAN I ENTER THE COMPETITION?
5. The Competition is free to enter (no purchase necessary).
6. Subject to clauses 7 and 9, the Competition is open to everyone who meets the eligibility requirements in clause 8 below, residing in South Africa with a valid South African passport at the time of taking up the Competition and during the Competition Period.
7. Please note before entering:
(a) The Competition involves extremely physically and mentally demanding challenges, including but not limited to operating the Promoter’s vehicles in all weather conditions, navigating unpredictable environments, and undertaking tasks that may be physically strenuous or psychologically stressful. Entrants acknowledge that participation may expose them to inherent risks, including but not limited to personal injury, psychological distress, property damage, or other unforeseen hazards beyond the Promoter’s control. By entering the Competition, entrants confirm that they are fully aware of and accept these risks, and that they voluntarily assume all responsibility for any consequences arising from their participation. Such risks may include, but are not limited to:
(i) Physical injury (e.g., sprains, fractures, dehydration, exhaustion);
(ii) Mental or emotional stress (e.g., anxiety, panic, fatigue);
(iii) Damage to personal property;
(iv) Exposure to extreme weather or environmental conditions;
(v) Accidents involving vehicles or equipment;
(vi) Delays or disruptions due to unforeseen circumstances.
(b) should an entrant be successfully selected to participate in the Competition, they will be required to execute additional documentation, including but not limited to: health declarations, liability waivers, indemnity agreements, and image and likeness releases. These documents are intended to further acknowledge and mitigate the risks associated with participation and to protect the Promoter and its affiliates from any resulting claims or liabilities;
(c) entrants must be prepared to live in the outdoors for up to 21 (twenty-one) days in close proximity to the other entrants, in potentially harsh climates and rugged environments, as part of the Competition;
(d) the Competition may be unsuitable and therefore not recommended for those who suffer from back or neck problems, heart conditions (or any other similar conditions). It may also be unsuitable for those who are pregnant. The Promoter would recommend entrants check, with a doctor or qualified medical professional, whether they are suitably fit, healthy and clear to take part in the Competition before entering. The Promoter may require evidence of such health clearance from any entrant; and
(e) entrants must be prepared for all weather conditions and will be responsible for providing their own appropriate clothing, gear and equipment in anticipation of varying extreme weather scenarios (including but not limited to: waterproof clothing, warm layers, protective and appropriate footwear for hiking and climbing, suncream, etc.). The Promoter will not be responsible for providing this. The Promoter shall not be liable for an entrant’s failure to adequately equip and/or prepare for environmental conditions and the Promoter shall not be liable for any direct or indirect consequences, whether foreseeable or unforeseeable, that may arise as a result of such failure.
ELIGIBILITY CRITERIA
8. To be eligible to enter, each entrant must:
(a) Register their interest to participate by 31 July 2025 at 13:00pm, by submitting the relevant form hosted at: www.landrover.co.za/defender/index.html (“Register of Interest”); and
(b) Complete and submit the entry form as received via e-mail from the Promoter by 30 September 2025 at 13:00pm (“Entry Form”);
(c) be able to swim a minimum of 50 (fifty) meters unassisted and unaided;
(d) demonstrate that they can communicate in English, which will be the language of the Competition, to understand detailed instructions and provide input and feedback to other entrants in potentially dangerous situations where accurate, immediate and clear communication is essential;
(e) possess a healthy level of physical and psychological fitness, as the Competition involves a number of physically and mentally demanding challenges. Entrant’s eyesight must also meet the standard required for driving;
(f) due to the Promoter’s insurance requirements, be 23 years old or over, and possess a valid South African driver’s licence for a minimum period of at least 5(five) years with no convictions, no outstanding fines, warrants of arrest or pending proceedings against their name at the time of entering and during the Competition Period. Entrants will be asked to present their drivers’ license to the Promoter so should ensure that they bring it with them to any and all events related to the Competition;
(g) pass the drivers’ license verification check that will be sent to entrants via web link or by way of any other verification method as may be determined by the Promoter;
(h) be fit to travel overseas, should they be determined a Local Finalist (as defined below);
(i) possess a valid international driver’s license, or be able to obtain one should it be required by the Promoter or for purposes of the Competition, as the final of the Competition will take place in an international location that will be revealed by the Promoter during the Competition Period. Successful entrants will be responsible for obtaining their own visas and vaccinations at their own costs (including any other documentation required for travel to the destination); and
(j) have no criminal record.
9. The following entrants will not be eligible to enter the Competition:
(a) all those who do not meet the eligibility criteria set out in clause 8 above;
(b) any employee (hourly or salaried), independent contractors, graduates, agents or apprentices working for the Promoter and/or its affiliates (including but not limited to Jaguar Land Rover Limited) at the time of taking up the Competition and during the Competition Period;
(c) any third party, employee (hourly or salaried), independent contractor, apprentice or volunteer working for or associated with any company principally involved in the manufacturing, sale or distribution of automotive vehicles (the “Brand Sector”); and/or;
(d) any employees, directors, agents, or consultants of the Promoter, Jaguar Land Rover Limited, their affiliates, advertising agencies, and immediate family members of any of the foregoing. The Promoter reserves the right to verify the eligibility of all entrants and to disqualify any entrant who breaches these Terms or engages in any unlawful or dishonest conduct.
(e) anyone currently suffering from any physical or mental condition which would restrict or impair their alertness or driving ability. Participants acknowledge and agree that they must be in a physical and mental condition that does not impair their ability to safely participate in the Competition or any related activities. Any individual who is, at the time of entry or during the Competition, suffering from a condition, whether physical or psychological, that may reasonably be expected to impair their alertness, judgment, or ability to safely operate a vehicle or engage in any Competition-related activity, shall be deemed ineligible to participate. The Promoter reserves the right, in its sole discretion, to disqualify any Participant on the basis of health or safety concerns, and such decision shall be final and binding.
10. In entering the Competition, entrants confirm that they are eligible to do so and eligible to claim any prize they may win. It will be the Promoter’s sole decision as to whether any eligibility requirement has or has not been met and the Promoter may, at its sole discretion, require evidence or confirmation from entrants before awarding Prizes.
11. Initial Competition entries, as envisaged by Clause 15 below, are open from the 19th of June 2025 and closes at 13:00 on the 31st of July 2025, both days inclusive. The Competition will continue until 31 October 2026 (the “Closing Date”). Entries submitted outside of the prescribed timelines as set out herein, will automatically be disqualified.
12. Entrants may submit up to 1 (one) valid entry. Any additional entries will not be counted or eligible to win.
13. The Competition will require access to: a cellphone; an email account; a computer; and internet access – these will not be provided by the Promoter. Data and network costs are incurred solely at the entrant’s expense and will not be recoupable from the Promoter.
14. The Promoter reserves the right, at its sole and absolute discretion, to disqualify any entry or Participant that does not comply with these Terms and Conditions, or whose conduct is deemed to be inconsistent with the spirit, integrity, or intended purpose of the Competition. This right may be exercised at any time during the Competition Period, without prior notice, and the Promoter shall not be obliged to provide any justification or engage in correspondence regarding such disqualification. Any attempt to undermine the legitimate operation of the Competition may also result in immediate disqualification and may be subject to legal action.
HOW TO ENTER
15. To access the Entry Form (defined below), all entrants must first register their interest by completing the ‘register your interest’ form that can be found here: www.landrover.co.za/defender/index.html (“Register of Interest”). Applications for the Register of Interest will close on 31 July 2025 at 13:00, no further applications will be accepted after this time.
16. The Promoter will share an invitation to enter the Competition by sending an Entry Form to all entrants who have completed the Register of Interest process, via the email address entrants provided in their Register of Interest form by 13:00 on the 31st of July 2025.
17. Subject to clauses 15 and 16, all entrants who have been invited to enter the Competition after registering their interest must complete the Competition Entry Form (“Entry Form”) by 13:00 on 30 September 2025.
18. Only entries that have been answered in full, completed correctly and submitted will be considered as a valid entry.
19. If, for any reason, a technical interruption, equipment failure, telephone failure, network, server, computer hardware or software failure or site failure or postal failure occurs and the Competition is not capable of running as planned or entries are not received or validly submitted or the Prize (as defined below) is disrupted, the Promoter reserves the right to cancel, terminate, modify or suspend the Competition if necessary.
20. The Promoter does not take any responsibility for incomplete entries or entries that are lost, mislaid, defaced, damaged or delayed in transit (regardless of cause) and any such entries will not be considered valid. The Promoter will not accept proof of posting or transmission as proof of receipt of entry to the Competition. The Promoter therefore accepts no responsibility should entries not be received for whatever reason
21. Entrants (and subsequent ‘Local Competitors’) shall not, at any point during the Competition, display or publicize any political slogans or homophobic language, images of a lewd or explicitly sexual nature, images containing logos of competitors and overt brand sponsorship or anything else deemed to be ambush marketing or an abuse of the Promoter and/or Jaguar Land Rover Limited, content which is defamatory, obscene, illegal, vulgar, offensive or otherwise unsuitable or infringes others’ rights (including intellectual property rights) or reflects negatively upon the Promoter and/or Jaguar Land Rover Limited. Each entrant agrees and acknowledges that any breach of this clause will cause significant damage and loss to Promoter and Jaguar Land Rover Limited.
22. The Promoter reserves the right to cancel, terminate, modify or suspend the Competition if necessary.
FIRST ROUND OF THE COMPETITION
23. A select group of entrants who successfully registered their interest and completed the Entry Form will be chosen from all valid entries by an expert judging panel consisting of subject matter experts from the event, marketing and adventure industry, after the application process has closed at 13:00pm on 30 September 2025 (the “Local Competitors”).
24. As part of the initial selection process, the Promoter reserves the right to invite selected entrants to participate in interviews, either in person or virtually, to assist in the evaluation and selection of Local Competitors. These interviews are expected to take place during October 2025.Participation in such interviews may be a condition for progressing to the next stage of the Competition. The Promoter is under no obligation to conduct interviews with all entrants, and the decision to invite or not invite an entrant for an interview shall be made at the Promoter’s sole discretion.
25. Subject to clause 24, and after the initial selection process, a maximum of forty-eight (48) Local Competitors will be selected by the judging panel to participate further in a Local Selection Event. The decision of the judging panel regarding the selection of Local Competitors shall be final and binding and solely within the discretion of the judging panel.
26. The Local Competitors will be contacted via email and/or telephone using the contact details included in their Entry Form, within 2 (Two) weeks from 31 October 2025 and will be asked to confirm: that they accept the invitation to compete in the Local Selection Event; that they meet the eligibility requirements set out in clauses 8 and 9 of these Terms and Conditions; and that they are available to compete in the Global Final (defined in clause 31). Should any Local Competitor be unable to confirm any of the details above within 1 (one) calendar day, the Promoter reserves the right to revoke their space in the Local Selection Event and/or to offer it to an alternative entrant in their absolute discretion.
27. It is the responsibility of each entrant to ensure that the contact details provided in their Entry Form are accurate for notifications set out in clause 26 above.
28. The names and images of Local Competitors may be announced, published or broadcast through various media platforms at the sole discretion of the Promoter.
29. Local Competitors selected as per clause 25, will be required to participate in the Local Selection Event to be hosted from the 16th of November 2025 to the 25th of November 2025 (both dates inclusive) at the Defender Brand Experience Centre in Johannesburg or any other location as may be determined by the Promoter/ During the Local Selection Event, the Local Competitors will participate in a series of adventure challenges These challenges will include, but are not limited to: driving-challenges, off-road driving, swimming, endurance tests, mental agility tasks, compass-based navigation, physical challenges, and survival skills assessments
30. The Promoter will not be responsible for any expenses associated with the Local Competitors’ participation in the Local Selection Event (including but not limited to travel to and from the Local Selection Events), nor will the Promoter be responsible for arranging any such expenses, unless otherwise agreed to in writing by the Promoter or at the sole discretion of the Promoter.
SECOND ROUND OF THE COMPETITION
31. Following the Local Selection Event, a shortlist of up to twelve (12) Local Competitors will be selected by the judging panel to advance to a second round of the Competition (the “Final Local Challenge”). The selection of these twelve (12) participants will be based on their performance during the Local Selection Event and any other criteria determined by the judging panel at their sole discretion.
32. The Final Local Challenge will take place in February 2026 at a location to be determined by the Promoter. During this challenge, the shortlisted Local Competitors will participate in a series of advanced tasks and assessments designed to further evaluate their skills, endurance, teamwork, and suitability to represent South Africa at the Global Final.
33. At the conclusion of the Final Local Challenge, one (1) Local Finalist and two (2) runners-up will be selected by the judging panel. The decision of the judging panel shall be final and binding. The Local Finalist will proceed to represent South Africa at the Global Final as outlined in clause 35.
34. The Promoter reserves the right to modify the format, timing, or location of the Final Local Challenge at its sole discretion and will notify the selected participants accordingly.
THE GLOBAL FINAL
35. One (1) finalist (“Local Finalist”) and two (2) runners-up will be selected by an expert judging panel at the Final Local Challenge, at the sole discretion of the judging panel based on their selection criteria, and such decision shall be final and binding. The Local Finalist will progress to represent South Africa at the global final of the Competition. In the event that the Local Finalist is unable or unwilling to participate in the global final for any reason, one of the runners-up may be required to assume the winner’s obligations and represent South Africa, as determined at the sole discretion of the Promoter.
36. The Local Finalist shall compete in the global final of the Competition against other finalists from around the world in October 2026 in a secret international location that shall be revealed by the Promoter and/or Jaguar Land Rover Limited in August 2026 (the “Global Final”).
37. The Promoter and/or Jaguar Land Rover Limited will place all finalists from all participating countries into teams to compete in the Global Final. However, Finalists will be judged on an individual basis and not as a team. Team formation shall be at the sole discretion of the Promoter and/or Jaguar Land Rover Limited. The Promoter and/or Jaguar Land Rover Limited may re-arrange team members at any point during the Global Final.
38. Finalists may be eliminated from the Global Final, at the sole discretion of the expert judging panel, at any point. Any eliminated finalists will no longer be eligible to compete in the Global Final nor eligible to win the Competition.
39. The Promoter shall make all necessary accommodation travel, special clothing, technical equipment and dietary/meal arrangements to enable the Local Finalist to attend the Global Final and shall bear the cost of such (subject to the Promoter’s travel and expense policy).
40. Pursuant to clause 39 above, Finalists are responsible for arranging all other items and expenses, including but not limited to: their own visa, passport, vaccinations, travel insurance and any associated costs and expenses. Finalists acknowledge and agree that the Promoter will not be responsible for any costs and/or expenses (outside of those set out in clause 39) of attending the Global Final.
WINNERS & THE PRIZE
41. Subject to clause 33, winners will be selected from remaining Finalists by an expert judging panel at the end of the Global Final on the Closing Date (“the Winner(s)”).
42. Winners will be selected on an individual basis and not as a team. For the avoidance of doubt, there may be some Winners selected from a team where some team members will not be selected as Winners.
43. The Winners determined by the expert judging panel will be final and at the sole discretion of the judging panel.
44. The Winners will be determined and announced at the Global Final and awarded in person. Winners may also be announced via Jaguar Land Rover Limited’s ‘Defender’ channel on YouTube at the sole discretion of Jaguar Land Rover Limited.
45. Each Winner will win the prize. The prize is for the Winners to have the opportunity to participate in an expedition in the country that the Global Final is located, as a team, where they will be delivering essential aid to purposeful causes, using everything they have learned throughout the Competition, in October 2026 (“Prize”). The exact date of the Prize is subject to change at the discretion of the Promoter and/or Jaguar Land Rover Limited.
46. There are no alternative prizes, and the Prize is non-transferable and non-negotiable. The Prize may not be claimed by a third party on any Winner’s behalf.
47. If the Promoter subsequently discovers any Winner is ineligible or any Winner has breached these Terms and Conditions, or foul play or unethical conduct is suspected under these Terms and Conditions then the Promoter reserves the right to not award the Prize to such Winner and another Finalist will be selected by the judging panel as the Winner.
48. If the Prize offered is unavailable, cancelled or suspended due to circumstances beyond the control of the Promoter, the Promoter will not be able to offer an alternative and will not owe any further liability to the Winners. The Winners will not be entitled to any monetary equivalent or compensation for costs or expenses incurred or suffered in connection with taking up the Prize.
49. Winners accept that the Prize could be cancelled or suspended for any reason whatsoever beyond the control of the Promoter.
50. In the event that any Winner is unable to take up the Prize for any reason they must notify the Promoter immediately. In this circumstance, the Promoter reserves the right to offer the Prize to another Finalist. The Promoter does not accept any responsibility if a Winner is not able to take up the Prize.
51. The Winners acknowledge and agree that the Promoter will not be responsible for any costs and/or expenses (including but not limited to taxes) of taking up the Prize.
52. All taxes, levies, or duties, including income tax, which may be payable as a result of participation in the Competition or the receipt of any Prize, shall be the sole responsibility of the participant or winner. The Promoter makes no representations and shall not be liable for any tax obligations incurred by participants or winners. Winners are advised to seek independent tax advice and must declare any prizes received to the South African Revenue Service (SARS) in accordance with applicable laws.
53. In all circumstances, the Promoter's decision is final and no correspondence will be entered into.
54. The Winners shall not, while participating in the Prize, display or publicize any political slogans or homophobic language, images of a lewd or explicitly sexual nature, images containing logos of competitors and overt brand sponsorship or anything else deemed to be ambush marketing or an abuse of the Promoter and/or Jaguar Land Rover Limited, content which is defamatory, obscene, illegal, vulgar, offensive or otherwise unsuitable or infringes others’ rights (including intellectual property rights) or reflects negatively upon the Promoter and/or Jaguar Land Rover Limited. Each entrant agrees and acknowledges that any breach of this clause will cause significant damage and loss to Promoter and Jaguar Land Rover Limited.
RECORDING AND PUBLICITY
55. As a condition of entry into the Competition, all entrants agree to participate in promotional photography, videography, and other forms of content creation by the Promoter during and after their involvement in the Competition and/or Prize. Entrants will be required to sign a media release and consent form, which will be provided by the Promoter on or before the Local Selection Event.
56. By signing the media release form, entrants explicitly consent, in accordance with the Protection of Personal Information Act, 4 of 2013 (POPIA), to the collection, use, and processing of their personal information, including their name, image, likeness, voice, and biographical material, for marketing, promotional, and publicity purposes.
57. All content captured by or on behalf of the Promoter, including photographs, video footage, and audio recordings, shall be the sole property of the Promoter. Entrants hereby irrevocably assign to the Promoter all rights, title, and interest in and to such content, and waive any moral rights therein.
58. Entrants further agree to document their experience of the Competition from the point of selection as a Local Competitor until elimination or, if declared a winner, until the conclusion of the Prize. This includes creating photographs, videos, and other content (“User Generated Content”) for use by the Promoter.
59. Entrants grant the Promoter and Jaguar Land Rover Limited a worldwide, royalty-free, exclusive, irrevocable license to use, reproduce, edit, adapt, publish, distribute, and display all User Generated Content and any content captured by the Promoter in any and all media, including but not limited to websites, social media platforms (e.g., Instagram, Twitter, TikTok, YouTube), press releases, and events, in perpetuity. This license extends to use by the Promoter’s and Jaguar Land Rover Limited’s authorised agencies, affiliates, franchised retailers, national sales companies (NSCs), importers, and approved third-party partners acting on their behalf.
60. Entrants acknowledge that they will not be entitled to any compensation for the use of such content and that the Promoter and Jaguar Land Rover Limited, as well as their authorised partners and agencies, may use the content at their sole discretion, including for commercial purposes.
LIABILITIES
61. Neither the Promoter, Jaguar Land Rover Limited nor its affiliates, agents, officers, retailers, franchisees, sponsors or employees will be liable (to the extent permitted by law) for any loss, damage or injury, including death to any entrant and/or their property arising out of organising or holding this Competition or as a result of a Winner winning, participating in, collecting or enjoying the Prize and/or the Competition, or if the Competition does not run as planned. This paragraph and these Terms specifically do not seek to exclude nor restrict any rights, obligations and/or applicability of prescribed legislation which includes but is not limited to the Competition Act 89 of 1998, the Consumer Protection Act 68 of 2008. Furthermore, this paragraph or these Terms do not seek to exclude the liability of any party listed in this paragraph for (a) death or personal injury caused by their negligence, (b) fraud or fraudulent misrepresentation, and/or (c) any other matter for which it would be unlawful for them to exclude or attempt to exclude their liability. Your statutory rights are not affected.
62. Neither the Promoter, Jaguar Land Rover Limited nor its affiliates, agents, officers retailers, franchisees, or employees will be liable (to the extent permitted by law) for any medical, repatriation or consequential costs arising from illness or injury to the any entrant, Winner, and/or any third party in the course of the Competition and/or during any travel required.
63. The Promoter may change these Terms and Conditions or cancel the Competition at their absolute discretion, without prior notice and without incurring liability as a result unless the Prize has been awarded.
USE OF PERSONAL DATA
64. By entering this Competition, entrants (as an entrant, Local Competitor, Finalist and/or Winner) understand that the Promoter (and its agents, contractors and group members on its behalf) may process, store, distribute and/or use the information (including personal data) provided in their Competition entry and in the process of entering:
(a) To enable them to administer their entry in the Competition, including deciding whether it accords with these Terms and Conditions;
(b) To notify entrants if they are a Local Competitor, Finalist and/or Winner. Where you are a Local Competitor, Finalist and/or Winner you agree that the Promoter may announce or make available on request your name, country/town, image and User Generated Content, unless they object to the Promoters doing so or request that the amount of personal information announced or made available is reduced by the Promoters; and
(c) To share with organisations assisting with the management, organisation, promotion and/or conducting of the Competition and fulfilment of the Prize.
65. Entrants’ names and contact information used for the purpose of this Competition shall be retained for a period of 2 (two) years from the selection of Winners. Winners’ name and contact information used for the purpose of this Competition shall be retained for a period of 3 (three) years from the selection of Winners, with such period being subject to either a longer or shorter period as necessity and circumstance would demand.
66. Should any Winner object to their name and city/town of residence being announced or made available upon request by the Promoters, they should contact the Promoter. The Promoter will not announce or make available the personal information of any Winners who have objected. The Promoter may, however, need to provide such data for any lawful or regulatory purposes to a regulator.
67. Data will be handled in accordance with any data protection legislation from time to time in force in the South Africa including the Protection of Personal Information Act 4 of 2013 or any successor legislation and any other directly applicable South African regulation relating to privacy.
68. By entering the competition, entrants acknowledge and agree that their personal information may be transferred to, stored, and/or processed in a country other than their country of residence, including countries that may not have data protection laws equivalent to those in their home jurisdiction. In such cases, the Organiser will take reasonable steps to ensure that appropriate safeguards are in place to protect the confidentiality and integrity of the personal information, in accordance with applicable data protection legislation.

70. The Promoter therefore wishes to inform the entrants and/or Winner as to why they may require certain personal information and what the Promoter intends on doing with such personal information. The Promoter requires the entrant’s and/or Winner’s provided personal information in order to, inter alia:
(a) to enable them to administer your entry in the Competition, including deciding whether it accords with these Terms and Conditions;
(b) ensure that the entrant and/or Winner is provided with the Prize.
(c) for insurance purposes;
(d) to perform due diligence checks and confirmations;
(e) to ensure that the Promoter complies with all applicable laws including obtaining assurance from the entrant’s representatives that they hold a valid driver’s license and that the representatives of the possible Winner will therefore comply with the rules of the road under our Road Traffic laws;
(f) to ensure that the Promoter performs all required internal control activities and procedures;
(g) to ensure that the Promoter correctly concludes the Winners Agreement with the correct and eligible Winner;
(h) to ensure that the Promoter can protect the entrant’s and/or Winner and Promoter’s legitimate interests;
(i) to ensure that the Promoter can provide the entrant’s and/or Winner details, where applicable, to any government authorities and regulators;
(j) where relevant and applicable so long as the vehicle may be registered in the name of the Promoter, ensure that the Promoter can attend to the collection of any fees in respect of the vehicle and related services which include, for example traffic fines, toll fees charges or penalties arising from the use of the vehicle;
(k) to allow the Promoter to perform vehicle tracking and driver behaviour checks as may be necessary;
(l) to allow the Promoter to communicate with the entrants and/or Winner prior to, during and subsequent to the lapse of the Competition or Winner’s Agreement;
(m) to allow the Promoter to share the Recipient’s information with their various service providers, including the Promoter’s business partners, insurance companies, fleet service providers, vehicle tracking service providers, their retailers and retailer’s staff, their trading and business partners, the Promoter marketing, PR and advertising agencies, as well as to the Promoter affiliated or associated companies; and
(n) to allow the Promoter, its retailers and/or the Promoter’s business partners to contact the entrants and/or Winner for marketing and advertising purposes, including, but without any guarantee, inviting the entrants and/or Winner to the Promoter’s Experiences or providing the Recipient with the Promoter’s vouchers and/or promotional goods.
71. The entrants and/or Local Finalist and/or Winner (subject to necessary limitations) have:
(a) the right to object to the Processing of their, or any of their representative’s personal information;
(b) the right to have their personal information updated or corrected;
(c) the right to request the Promoter to provide the entrant and/or Winner with the details of all the personal information held on the entrant’s and/or Winner’s behalf;
72. the right to opt-out to any further communications or engagements by the Promoter.
73. Entrants’/Local Competitors/Winner’s name and contact information used for the purpose of this Competition shall be retained for a period of 3 (three) years from the Closing Date.
74. Data will be handled in accordance with (i) any data protection legislation from time to time in force in South Africa, being (i) the Protection of Personal Information Act, 4 of 2013 ("POPIA"), including any amendments, updates and regulations published; (ii) any other applicable South African data protection laws in force from time to time and (iii) [UK data protection legislation including the Data Protection Act 2018 or any successor legislation; and (iv) for so long as and to the extent that the law of the EU has legal effect in the UK, the General Data Protection Regulation ((EU) 2016/679), and any other directly applicable EU regulation relating to privacy.

GENERAL
77. The Promoter, Jaguar Land Rover Limited and their affiliates shall not be held liable for any failure to perform or delay in performing any of their obligations under these Terms and Conditions if such failure or delay is caused by events beyond their reasonable control, including but not limited to acts of God, natural disasters, war, terrorism, civil unrest, strikes, pandemics, government restrictions, or failure of public or private telecommunications networks (“Force Majeure Events”). In such cases, the Promoter reserves the right to cancel, modify, or suspend the Competition without incurring any liability.
78. These Terms and Conditions shall be governed by and construed in accordance with the laws of the Republic of South Africa. Any disputes arising out of or in connection with the Competition or these Terms shall be subject to the exclusive jurisdiction of the courts of South Africa.
79. If any provision of these Terms and Conditions is found to be invalid, unlawful, or unenforceable by a court of competent jurisdiction, such provision shall be severed from the remaining provisions, which shall continue to be valid and enforceable to the fullest extent permitted by law.
80. This Competition is conducted as a promotional competition in accordance with Section 36 of the Consumer Protection Act 68 of 2008 and does not constitute a lottery as defined in the Lotteries Act 57 of 1997. The Competition is free to enter and does not require any form of payment, purchase, or consideration to participate, other than standard data or communication charges.
81. The Promoter confirms that the Competition is not intended to be, and shall not be construed as, a lottery, sports pool, or any other form of gambling activity regulated under the Lotteries Act or any other applicable gambling legislation.
82. The Promoter undertakes to comply with all applicable laws and regulations, including but not limited to the Consumer Protection Act, Protection of Personal Information Act (POPIA), and any advertising standards or industry codes of conduct relevant to promotional competitions in South Africa.
Sanctions and Compliance
83. The Promoter, Jaguar Land Rover Limited, and their affiliates reserve the right to disqualify any entrant or revoke any Prize if such participation or award would violate applicable laws or regulations, including but not limited to international trade, economic, or financial sanctions imposed by the United Nations, European Union, United Kingdom, United States, or the Republic of South Africa.
84. By entering the Competition, entrants represent and warrant that they are not subject to any sanctions or restrictions under any applicable sanctions regime and that their participation does not violate any such laws. Entrants further agree to provide any information reasonably requested by the Promoter to verify compliance with this clause.
85. The Promoter shall not be liable for any failure or delay in performing its obligations under these Terms and Conditions if such failure or delay results from compliance with applicable sanctions laws or regulations.
86. The Promoter reserves the right to amend, update, or modify these Terms and Conditions at any time, without prior notice, and such changes shall be effective immediately upon publication on the Promoter’s official website or other designated communication channels. It is the responsibility of entrants to review these Terms and Conditions regularly. Continued participation in the Competition following any such amendments shall constitute acceptance of the updated Terms and Conditions
